What if I don’t want a divorce?

 

It can be difficult when one party to a marriage has decided it is over and one is still hopeful of reconciliation. If there is a chance of fixing things it may be a good idea to engage with a marriage counsellor or psychologist to assist you both during this process. If you have been married for less than two years, this is a requirement before any divorce proceedings can be commenced in any event.

If you have been separated for 12 months and the other person considers that reconciliation is not likely, the Court will grant a divorce upon an application being made. If you do not agree with anything that is stated in the application, you can file a response, however it is unlikely to stop a divorce proceeding unless the date of separation is incorrect.
